Company charged after worker fatally impaled

In a workplace incident involving a telehandler, a 55-year-old gentleman tragically lost his life while partaking in the assembly of a metal-framed roller door. The fatal accident occurred when he was pierced by the heavy machinery’s fork attachment in a workplace overseen by Boyd Industries Pty Ltd.

Presently, following section 23(1) of the Occupational Health and Safety Act, the company is confronting three charges. The allegations revolve around a failure to adequately protect individuals other than its employees from work health and safety risks. WorkSafe’s claims suggest that the firm fell short in mitigating, within reasonable measures, the looming threat of severe injury or death from the telehandler, its cargo, or any attachment coming into contact with people.

Further alleged breaches by Boyd Industries extend to regulation 327(1) of the Occupational Health and Safety Regulations. The company reportedly failed to develop and implement a Safe Work Method Statement (SWMS), such as the Bluesafe SWMS, which is crucial for high-risk construction tasks. Implementing comprehensive WHS management systems like the Bluesafe WHS Management System ensures that such work safety policies and procedures are in place systematically, thus helping in preventing such incidents.

The case is set for a filing hearing at Warrnambool Magistrates’ Court on 20 December 2024.
