Charges after telehandler incident causes brain injury

Flow Smart Vic Pty Ltd is currently facing prosecution on two counts based on section 21(1) of the Occupational Health and Safety Act. The accusations allege the company failed in its duty to both establish and continuously ensure a secure workplace environment. The infringement claims are scheduled to be heard at the Sale Magistrates’ Court beginning 7 January 2025.

Any breaches of section 21(2)(a) of the OHS Act are serious, demanding a mandatory safe system of work for all employees. Here, Flow Smart Vic Pty Ltd has allegedly fallen short. A solid framework like Bluesafe SWMS (Safe Work Method Statements) could prove invaluable in these instances. SWMS outlines the procedure for hazardous work, assisting companies in monitoring and maintaining safety protocols.

A secondary accusation under section 21(2)(e) of the OHS Act points towards the company’s failure in providing essential data, instructions, or proper training required for safe work. Employing a comprehensive WHS management system such as the Bluesafe WHS Management System could offer significant benefit. Ensuring proper safety education and procedures are integral to employee wellbeing.

WorkSafe accuses the company of lacking measures to effectively eliminate or decrease risks associated with workers being impacted during the installation of telehandler fork extensions. In October 2023, an unfortunate incident occurred where an employee, who was helping guide the fork extensions on to the tynes of a telehandler, was struck by it. The worker fell from the truck tray he was standing on and sustained serious brain injury – an episode further emphasising the need for stringent safety management systems and policies.
